Probate Notes are a written summary of your case, drafted by the Court, prior to the court hearing. Probate Notes will include an identification of the parties involved in the matter, the relief sought, summaries of petitions and objections, and a listing of deficiencies in the petition. In essence, Probate Notes are the means by which the court communicates with the parties prior to the court hearing to tell the parties whether the matter will be approved or whether there are “deficiencies” (or matters to clear) with your petition.
Probate Notes are very important because they will list any “deficiencies” or “matters to clear.” Remedying these “deficiencies” (or matters to clear) is vital to the approval of any petition. To remedy a deficiency in a case, the Petitioner must file a “Supplement” verified and signed under the penalty of perjury to address the deficiencies raised by the court.
